In these Terms and Conditions, “we” “us” and “our” refer to A-Plus Print. Your access to and use of all information on this Website including purchase of our products are subject to the following Terms and Conditions.
1. General
All the terms and conditions and any transactions with us are subject to the laws of New Zealand. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained herein and hereafter. If you do not accept these Terms and Conditions you must immediately stop using the Website.
We reserve the right to make changes to this site and to these Terms and Conditions at any time without prior notice. You also agree that we may provide all legal communications and notices to you electronically by posting them on our Website or, at our discretion, by sending an e-mail to the e-mail address you provided to us when you registered at our Website. You may withdraw your consent to receive communications from us electronically by contacting customer service team at [email protected]. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.
2. Account Registration
In order to access the services provided on this Website, you must register an account. Account registration is available to individuals of at least 18 years of age. You must complete registration by providing certain information as set out on our registration page. Please refer to our Privacy Policy for information relating to our collection, storage and use of the details you provide on registration.
You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
We reserve the right to terminate your registration at any time if you breach these Terms and Conditions.
3. Product Descriptions
We strive to ensure that our products are described as accurately as possible on our Website, however we do not warrant that the description is accurate. Where we become aware of any misdescription, we reserve the right to correct any error or omission.
Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product. Colours can be verified by ordering a sample from the Website.
4. Placing Orders
When placing orders, you must tick the box “I’ve read and accept the Terms and Conditions “. We undertake to accept or reject your order within 3 days. If we have not responded to you within 3 days, your offer is deemed to be rejected. We are not required to give reasons for rejecting your offer to purchase however the most likely reason for rejecting your offer will be that we do not currently have that product in stock. We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our Website.
All prices are in New Zealand Dollars (NZD) and are exclusive of GST. We reserve the right to amend our prices at any time. If you have placed an order, we undertake to fulfil your order at the price listed at the time you ordered. Packaging and postage is an additional charge, calculated at time of purchase. Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to typographical error or similar oversight, we reserve the right to cancel a transaction. Where your credit card or debit card has been charged, we will immediately refund your credit card or debit card for the total amount debited.
5. Payment
You may pay for your order by credit card or direct debit online. We use the eWAY Payment Gateway for our online credit card and debit card transactions. Please refer to our Privacy Policy regarding online payment security.
If your credit card is declined, we will not process your order. If the order is shipped and should your account become delinquent, you agrees to pay a monthly finance charge of 1% (annual percentage rate of 12%) on the unpaid balance. In the event that we must commence legal action to enforce any terms of this agreement, you agree to pay reasonable legal fees and costs.
6. Delivery of Goods
Delivery of most products is by courier to anywhere in New Zealand (excluding Chatham Islands). Usually you can expect to receive your order within 3 – 5 business days after production, however this can be up to 7 business days depending on your location and courier service times.
There are certain products of digital print on fabrics such as Flags, Quick Display Wall and Pop Up Display Wall are produced overseas. The production and delivery of these products may take 10 working days or more. Please refer to each product description to make sure you can accept all the conditions for delivery.
The risk in the goods passes to you on delivery. All goods, delivered or not, remain our property until payment is received in full.
7. Returns
Due to the nature of our products, no refund can be made once the order is processed. Any claims for defects, damages or partial loss of goods in transit must be made in writing to us within 3 clear days of delivery or, in the case of no-delivery within 28 days of dispatch of the goods.
In the case of faulty or damaged goods, you must return the goods in question, unused and in their original packaging to us. We reserve the right to rectify defective work by reprinting or credit your account if we deem a refund should be made. We will not replace the order if it is determined by us that the goods were misused or mishandled by you.
8. Copyright
All copyright, trade marks and all other intellectual property rights in the Website and its content including without limitation the Website design, text, graphics and all software and source codes connected with the Website are owned by or licensed to us or otherwise used by us as permitted by law.
We claim no ownership rights to any images you submit to us. You grant us and to our third party service providers, a perpetual, worldwide, non-exclusive, transferable, royalty-free, copyright licenses to copy, reproduce, display, modify, adapt or alter, transmit, and distribute your images for the purpose of allowing us to fulfill your orders, and for the purpose of allowing you to use our service. Provided we comply with our obligations under these Terms and Conditions, you warrant that you will not make any claim against us or our third party service suppliers, for any use, publication or copying of your photos and materials and you waive all rights of action or other claims you may have now or in the future against us in respect of any such use, publication or copying.
You shall be responsible for obtaining all necessary authorities and consents to reproduce pictures, artwork, photographs, copyright text and/or any other reproducible materials prior to instructing us to reproduce the same. You shall indemnify and hold our representatives harmless against all claims, demands, actions, costs, expenses (including but not limited to legal costs and disbursements), losses and damages arising from or suffered or incurred by reason of any claim (including but not limited to the defence of such claim) that the reproduction of the materials by us infringes the intellectual property or other rights of any third party or misuses the confidential information of a third party.
9. Disclaimers
We are not responsible for ensuring that the information that you access or make available through using this Website will be private or secure or free from viruses or other harmful things. We do not and cannot guarantee availability of our Website and services or that there will be no interruptions or delays in relation to our website or services.
We are not responsible to you, or anyone else for any information that does not originate directly from us, any links we provide to third party sites or information at or accessible from those sites or any loss or damage arising from your use of this Website.
The storage on this Website is not a backup service. It is your responsibility to backup your data. We will not be liable for any loss of data and artworks. We reserve the right to restrict individual account storage to a reasonable level at our discretion.
10. Limitation of Liability
To the maximum extent permitted by law, in no event shall we or our officers, directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not we have been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or of failure to provide products or services that you order from us, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall we be liable or responsible for any damages or consequences arising from or related to your inappropriate or unauthorised use of this site or its content.
